Allergy & Food Safety Warning

Beyond the Basket is not an allergen-free facility. Our products may contain or come into contact with milk, eggs, wheat, peanuts, tree nuts, soy, and other allergens.

It is the absolute responsibility of the customer to verify any food sensitivities before consumption and to communicate any allergies or dietary restrictions at the time of order. By placing an order, you acknowledge that Beyond the Basket cannot be held liable for any adverse allergic reactions.

1. Acceptance of Terms

By accessing and using the Beyond the Basket website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of the updated terms.

2. Order & Delivery

  • All orders must be placed through our website at least 48 hours in advance for standard products. Special orders may require additional lead time.
  • We deliver within Toronto and the Greater Toronto Area (GTA). Delivery fees are calculated based on your delivery city and confirmed at checkout.
  • The customer is responsible for providing accurate delivery details (address, recipient name, phone number, and preferred delivery date).
  • Beyond the Basket is not responsible for spoiled items due to incorrect addresses, unattended deliveries, or recipient unavailability at the scheduled time.
  • We will make reasonable efforts to deliver within the requested time window, but exact delivery times cannot be guaranteed due to traffic and other factors.

3. Cancellations & Refunds

  • Cancellations made 4 days or more prior to the scheduled delivery date are eligible for a 100% full refund.
  • Orders cancelled less than 48 hours before delivery are non-refundable (0% refund) as products are prepared fresh.
  • If we are unable to fulfill your order due to circumstances within our control, you will receive a full refund.
  • No refunds will be issued for dissatisfaction related to personal taste preferences.

4. Product Substitutions

Due to seasonal availability and supply chain factors, we reserve the right to substitute specific flowers, fruits, or gourmet items with alternatives of equal or superior value. We will make every effort to maintain the overall aesthetic and quality of your basket. Major substitutions will be communicated when possible.

5. Payments

  • All prices are listed in Canadian Dollars (CAD) and are subject to applicable taxes.
  • Payments are processed securely through Stripe. We accept major credit cards.
  • Orders are confirmed only after successful payment processing and after you contact us on WhatsApp as instructed on the order confirmation page.
  • We do not store your credit card information. All payment data is handled directly by Stripe.
  • Promotional codes and coupons must be applied at checkout and cannot be combined unless explicitly stated.

6. Custom Orders

Custom orders are welcome and may require additional consultation. Customization requests must be submitted at the time of order. While we strive to accommodate all requests, we reserve the right to decline requests that are not feasible or do not align with our product standards.

7. Limitation of Liability

Beyond the Basket’s liability is limited to the value of the products purchased. We are not liable for indirect, incidental, or consequential damages arising from the use of our products or services. This includes but is not limited to allergic reactions, delivery delays due to circumstances beyond our control (severe weather, traffic accidents, etc.), or dissatisfaction based on personal preferences.

8. Intellectual Property

All content on this website, including images, text, logos, and designs, is the property of Beyond the Basket and is protected by copyright laws. Unauthorized use, reproduction, or distribution of our content is strictly prohibited.

9. Governing Law

These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes arising from these terms shall be resolved in the courts of Toronto, Ontario.
